Berserk Season 4 Quests

General

• 1) The competition is a game of skill.
• 2) The material used to market and promote the competition forms part of the competition terms.
  If there is an inconsistency between the material used to market and promote the competition and the competition terms, the competition terms prevail.

Eligibility to enter

3) During the promotional period, anyone may enter the competition, provided that they are:

• (a) over 18 years of age or have the approval of an adult to participate in this competition;
• (b) a current My Forge user or a new My Forge user who registers during the Promotional Period;
• (c) Playing the game Berserk that has been downloaded through the Vulcan Launcher, Android Play store or Apple store (test versions aren’t counted as eligible);
• (d) not an employee or someone working with Vulcan Forged or an immediate family member or friend who is directly or indirectly associated and connected with the organisation of this competitio

Entering

4) By entering the competition, entrants accept the competition terms.

5) How to enter:

• (a) There are two major draws set by Vulcan Forged. To receive an entry to the Season Quest major draw, entrants must complete at least three out of six tasks. To receive an entry to the Referral Quest draw, entrants must complete all the tasks. The tasks are outlined in paragraph 5c. Each quest must be completed between 12:01am (UTC) on 12/10/2023 and 11:59pm (UTC) on 22/11/2023 (Promotional Period). The Promoter reserves the right to add, remove or change the criteria during the competition period as long as a 24h notice is provided.
• (b) There are six minor draws set by Vulcan Forged. To receive an entry to each, entrants must earn at least 800 Intract XP during the set periods outlined in paragraph 5c. The Promoter reserves the right to add, remove or change the criteria during the competition period as long as a 24h notice is provided.
• (c) there are two skill-rating based leader boards. Players must rank at least 200th in either Starter or Ranked Leagues to qualify for a prize. Players may only receive a prize for one league. If a player competes in multiple leagues the higher value prize will be given:
• (d) Altogether, there are 10 major and minor quests set by Vulcan Forged and 2 Skill Rating Leader boards:

• 6) You will automatically be entered in the major draws, providing you meet the criteria detailed in paragraph 5a and 5c for each of these Quests.
• 7) You will automatically be entered in a minor draw, providing you meet the criteria during the right date and time detailed in paragraph 5c.
• 8) If, subsequent to a qualifying entry, you do not wish to participate in the competition you must advise the promoter by email [email protected].

Drawing Winners & Prohibiting Access

9) The promoter may disqualify any entrant who:

• a) enters the competition without being eligible;
• b) plays with 2 accounts at the same time in the same game. This is effective no matter what device you use. You can only use one account to play games;
• c) creating multiple accounts or take advantage of conditions of a giveaway (referreal, airdrop or similar);
• d) tampers with the entry process;
• e)submits an entry that is not in accordance with the competition terms; or
• f) in entering the competition, engages in conduct which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the competition or the promoter.

10) Without limiting any other provision of these terms of use, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the game apps and the smart contract (including blocking certain IP addresses) to any entrant for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these terms of use or of any applicable law or regulation. We may terminate your participation in the site, the app and the smart contract at our sole discretion;

11)Failure by the promoter to exercise its rights under paragraph 9 does not constitute a waiver of the promoter’s rights under paragraph 9. If the entrant’s contact details change, the entrant must notify the promoter.

12) The promoter will draw the winners from the pool of valid entries at the draw time on the draw date.

13) For the Season Quest major draw, the first valid entry drawn will win the First Prize, the second to eleventh valid entry drawn will win the Runner-Up prize, subject to the promoter’s rights under paragraph 6.

14) For the Referral Quest major draw, the first valid entry drawn will win the First Prize, the second to eleventh valid entry drawn will win the Runner-Up prize, subject to the promoter’s rights under paragraph 6.

15) For each minor draw, the first valid entry drawn will win the First Prize, subject to the promoter’s rights under paragraph 7.

16) The promoter will notify and provide a list of winners on Discord and/or the Vulcan Forged website within 14 days after the draw date. The promoter will not notify winners individually.

17) The awarding of prizes is restricted to one prize per entrant across all minor draws. That means an entrant can only win one minor prize during the promotional period. All eligible entrants and winners from the minor draws are eligible for the major draw.

Awarding Prizes

18) Each prize will be automatically allocated to the wallet address associated with the Winner’s Entry by 07/12/2023. This excludes the major draw requiring up to 4 additional weeks to organise.

19) The promoter may request that the winners provide proof of identity, proof of age or proof of residency to the promoter’s reasonable satisfaction before awarding the prize. If upon request a winner does not provide proof of identity, proof of age or proof of residency to the promoter’s reasonable satisfaction within 2 weeks after being selected as a winner, then the relevant Winner may be deemed to have forfeited their entitlement to their prize. In those circumstances the promoter may redraw the prize in accordance with paragraph 1 in Awarding Prizes.

20) The winner must accept the prize within 2 weeks after being drawn as the winner. If the winner does not accept the prize within 2 weeks after being drawn as the winner, the promoter may redraw the prize in accordance with paragraph 2 in Awarding Prizes.

21) In consideration of the promoter awarding the prize to the winner, the winner:

• a) consents to the promoter, without royalty or any fees, using his or her username, likeness, avatar, and entry in any marketing and promotion of the competition, the promoter or the promoter’s business;
• b) agrees to use the prize in accordance with the specified conditions and requirements;
• c) agrees that the prize is not transferable or exchangeable and cannot be taken as cash;
• d) agrees to comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties

22) If the prize is unavailable, the promoter may substitute the prize with a substitute prize, provided that the substitute prize is of the same or similar value as of the draw date.

Further Draw

23) If for any reason, the prize has not been awarded within 2 weeks after the draw date the promoter may conduct a further draw from the pool of valid entries on 15/01/2024.

24) The first drawn valid entry the promoter draws is the winner, subject to the promoter’s rights under paragraph 6 and 7.

25) The promoter might notify the further draw winner on Discord within 7 days after the draw date.

Force Majeure

26) If there is a force majeure event which prevents or materially and adversely affects the promoter’s ability to market, promote and run the competition in accordance with the competition terms, the promoter may cancel, terminate, modify, suspend or postpone the competition, subject to State Licensing Authorities approval.

Liability

27) The promoter is not liable for any loss, expense, damage or liability suffered or incurred by entrants and winners in connection with the competition, including:

• a) any charges incurred as part of downloading Vulcanverse, Vulcan Runner, Tower Defence or Berserk;
• b) any redress if your phone or computer does not support some or all of our games;
• c) any late, lost, altered, damaged or misdirected entries or prize acceptance, including delays due to technical disruptions or network congestion;
• d) any incorrect or inaccurate information caused by equipment or programming associated with or utilized in the competition;
• e) any technical error, including any omission, interruption, deletion, defect, delay in operation or transmission or communications line, telephone, mobile or satellite network failure; and
• f) any theft, destruction, unauthorized access to or alteration of entries; and
• g) any use of the prize or any tax liability incurred by the winner as a result of accepting the prize.

28) Nothing under paragraph 1 in Liability intended to limit entrants or winners’ rights

29) This promotion is in no way sponsored, endorsed or administered by, or associated with, Discord, Twitter, Facebook or Instagram and neither of these are liable for any loss, expense, damage or liability suffered or incurred by entrants and winners in connection with the competition, including anything detailed under paragraph 1 in Further Draw.

Personal Information

30) The Promoter collects information about entrants in order to run the competition, communicate with you as the Entrant to this Competition, and award prizes. The Promoter uses and manages entrants’ personal information in accordance with its privacy policy https://vulcanforged.com/PrivacyPolicy/Index We may also share your personal information with third parties who support us in our marketing or promotional activities. Vulcan Forged will be unable to consider your entry into this Competition if you do not provide this information. Vulcan Forged will not disclose this information provided by you unless required or authorized by law or in accordance with our Privacy Policy. By entering the competition, each entrant consents, without royalty or any fees, to the promoter using their personal information for future marketing and promotional purposes.
